Blue Right Technology Holding Sdn Bhd (hereinafter referred to as “Blue Right”) respects and is committed to the protection of your personal data and your privacy. This Privacy Policy (“Policy”) explains how we collect and handle your personal data in accordance with the Malaysian Personal Data Protection Act 2010 (“Act”). Please note that Blue Right may amend this Policy at any time without prior notice and any such amendment will be notified via our website or by email or through any other suitable modes of communication. 

  1. Type of personal data Blue Right collects  

Personal data means any information which relates to you and which was collected or provided to Blue Right. Personal data may include your name, contact details, address, identification card number, identification documents, passport details, images, photographs, audio or recordings, email address, login name and password, nationality, gender, race, vehicle ownership information, location tracking or global positioning system (“GPS”) information and any other personal data that you provide to us for the purpose of the commercial transaction between us.  

(2) Source of personal data 

Blue Right collects your personal data: 

  • when you sign up to be a user in Blue Right’s mobile applications and/or website (collectively referred to as “platform”); 
  • when you register and/or use our services or platform; 
  • when you contact us directly through Blue Right’s website and / or customer service team; 
  • through any marketing events or activities that you attended or participated, such as (but not limited to) road shows and online campaigns; 
  • through customer surveys conducted; 
  • through third parties such as our business partners and / or your agents; 
  • through regulatory authorities; and 
  • through cookies from the use of Blue Right’s mobile applications and/or website. 

All information requested from you is obligatory to be provided by you unless stated otherwise. Should you fail to provide the obligatory information, we may be unable to provide you with the relevant services or process the relevant commercial transactions. Your access to and/or usage of our platform and/or services may also be restricted. 

  1. Purposes for collecting and processing your personal data 

Your personal data is collected and further processed as required or permitted by law and to give effect to your requested commercial transaction, including the following: 

  • to create and/or update your account; 
  • to verify your identity; 
  • to track the usage and performance including but not limited to remembering your interests and preferences; 
  • for Blue Right’s internal records management; 
  • to provide you with user support; 
  • to send you marketing and promotional information or materials relating to goods, products and/or services (of Blue Right or of any third parties whom Blue Right may collaborate with) through various modes of communication such as SMS, email, newsletters and notifications; 
  • to ensure that the content of Blue Right’s website and/or mobile applications are presented in the most effective manner for you and for your computer and / or device; 
  • to tailor the displaying content of Blue Right’s website and/or mobile applications according to your interests and preference; 
  • to improve the quality of Blue Right’s services; 
  • to support the business, financial and risk monitoring, planning and decision making of Blue Right; 
  • for internal investigations, audit or security purposes; and 
  • to comply with Blue Right’s legal and regulatory obligations in the conduct of its business. 

Please note that you are responsible for any third party personal data obtained, published or shared through Blue Right’s mobile application and/or website and by doing the same, you confirm that you have obtained the third party’s consent to provide the personal data to Blue Right. 

  1. Disclosure or transfer of personal data  

Your personal data provided to us may be disclosed to the following classes of third parties for the purposes as stated above. Such third parties include, without limitation: 

  • Blue Right’s related companies, subsidiaries, holding companies, associated companies and outsourcing partners; 
  • our business partners such as insurance companies, banks and financial institutions; 
  • third parties appointed by us to provide services to us or on our behalf (such as auditor, lawyer, company secretary, service providers, vendors, consultants and other advisers); 
  • third parties whom Blue Right may collaborate or tie up with including but not limited to marketing and advertising agencies, 
  • government departments or agencies, statutory authorities and industry regulators; and 
  • any person to whom we are compelled or required to do so under law or in response to a competent or government agency. 
  1. Link to other sites and cookies  
  • Links to other sites may be provided on Blue Right’s website and/or mobile applications for your convenience and information. These sites may have their own privacy statement and Blue Right does not control, recommend or endorse these sites and Blue Right will not be held responsible for these sites or their contents. As such, Blue Right encourages you to read the privacy policies of these sites. 
  • Location enabled products or applications transmit your location information to us. Blue Right will not use the information sent or provided by you for any other purposes other than to provide the services you requested. Location enabled features are opt-in and you have control over your participation and can turn these services off at any time or uninstall them. Some mobile applications will utilise Google Analytics (or a similar tool) to help Blue Right better serve you through improved products, services and revisions to the mobile applications. The information collected will not allow Blue Right to identify you. It may, however, let us know anonymously, the services and/or products most searched by you within the application as well as device type used and your country of origin. 
  • In processing your information, cookies, which is a text file placed into the memory of your computer, may be used. Blue Right is able to use these cookies to identify you. Blue Right may be able to collect the following information during your visit to our website and / or the fully qualified domain name from which you accessed our site, or alternatively, through your internet protocol (“IP”) address: 
  1. the date and time in which you accessed our website; 
  1. the URL of any webpage from which you accessed our website;  
  1. the web browser which you are using and the pages which you have accessed; and 
  1. the user’s behaviour such as the duration of time you spent on the site and the pages you visited. 
  1. Mobile Applications 

Device permissions for personal data access 

Depending on your specific device, Blue Right’s mobile application may request certain permissions that allow it to access your device data described below.  

By default, these permissions must be granted by you before the respective information can be accessed. Once the permission has been given, it can be revoked by you at any time. Please note that the revoking of such permissions might impact the proper functioning of Blue Right’s mobile application. 

Approximate location permission (non-continuous) 

Used for accessing your approximate device location. Blue Right’s mobile applications may collect, use, and share your location data in order to provide location-based services. 

Your geographic location is determined in a manner that is not continuous. This means that it is impossible for Blue Right’s mobile applications to derive your approximate position on a continuous basis. 

Phone permission 

Used for accessing a host of typical features associated with your phone. This enables, for instance, read-only access to the “phone state”, which means it enables access to the phone number of the device, current mobile network information, or the status of any ongoing calls. 

Storage permission 

Used for accessing shared external storage, including the reading and adding of any items. 

System logs and maintenance 

For operation and maintenance purposes, Blue Right’s mobile application and any third-party services may collect files that record interaction with Blue Right’s mobile application (System logs) and use other personal data (such as the IP Address) for this purpose. 

  1. Right to access and correct personal data 

You have the right to access, verify, update and correct your personal data held by us when you are signed into through Blue Right’s mobile applications and/or website.

  1. Retention Period 

Blue Right may retain and processed your personal data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws. We will cease to retain your personal data as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected and is no longer necessary for legal or business purposes. 

  1. Limiting the processing of personal data, further enquiries and complaints 

Blue Right endeavours to take appropriate security measures to prevent unauthorized access, disclosure, modification or unauthorized destruction of the personal data.   1. Conflict 

In the event of any conflict between this English language Privacy Policy and its corresponding Bahasa Malaysia Privacy Policy, the terms in this English language Policy shall prevail.
